CERTIFICATION OF INFORMATION

I certify that the information provided in this Application is complete, correct and true to the best of my knowledge.

CONSENT TO CREDIT REPORT AND OTHER INQUIRIES

I authorize MotoLease, LLC, and its affiliates, agents, successors and assigns and their third party contractors/agents (“you”) to pull my credit report from the credit reporting agencies and to investigate my credit, employment, and income records. I agree that you may obtain credit and employment information about me by any means, including obtaining information from check or credit-­‐reporting agencies and from other sources. I also authorize you to obtain my consumer report (credit report) for any reason and from time to time in the future when updating, renewing or extending my lease contract. I agree that you may do so at the time I obtain my lease or any time after my lease is terminated if I owe you any money relating to the lease. If I request, I will be informed of whether credit reports were obtained, and, if so, I will also be informed of the associated names and addresses of the credit bureau(s) that provided those reports. I hereby give you consent to contact my current motorcycle lessor, its agents or affiliates, to obtain information about my payment history and current status of my existing motorcycle lease for purposes of considering me for a new lease with you or any other purpose as allowed by applicable law. I authorize you and (to the extent provided in your privacy policy available at http://motolease.net/privacy) your affiliates to offer me other vehicle leasing related products and services. I also hereby authorize my wireless operator to use my mobile number, name address, email, network status, customer type, customer role, billing type, mobile device identifiers and other subscriber status details, if available, to allow verification of my identity and to compare information that I have provided to you with my wireless operator account profile information for the duration of the business relationship.

CONSENT TO CALLS, TEXT MESSAGES, EMAILS AND RECORDINGS

By providing telephone numbers for a home phone, or cellular phone, or other phones in this Application, I am expressly consenting to you sending me communications at these numbers, including, but not limited to, you calling me at these numbers with automated dialing systems, prerecorded voice message calls, text messages. I also agree that phone calls to and from such phone numbers may be recorded. By providing my email address, I am expressly consenting to receiving communications at my email address as you, your agents and your affiliates may deem necessary.

You can opt-out to receive emails at any time by using the Safe Unsubscribe® link, found at the bottom of every digital email MotoLease sends.

CO-APPLICANTS

Depending on the status of my credit in relation to any co-applicant’s credit, you may treat the co-applicant as the primary applicant to achieve the best possible lease terms.

APPLICATION SUBJECT TO APPROVAL

I further understand that this Application is not a promise, acceptance, nor a commitment to provide a lease contract to me but solely a request that lease be provided to me under the terms and conditions to be disclosed in the Lease Contract which will be provided to me upon approval of my Application.

MOTOLEASE LLC PRIVACY POLICY EFFECTIVE 09/20/2016

This policy applies to the practices of MotoLease, LLC (“MotoLease” or “We”) with respect to information it collects about you online on its websites including www.motolease.net.

WHAT INFORMATION DOES MOTOLEASE COLLECT?

I certify that the information provided in this Application is complete, correct and true to the best of my knowledge.

We collect Customer Information which includes name, address, income, social security number, credit card number, bank information, e-mail address, phone number, IP address, what Web site visitors come from, which pages are visited at this Web site, and information about online activities that are directly linked to them. We collect Customer Information if you visit our Web sites to register, apply for lease, purchase a product or inquire about our products and services.

MotoLease also uses cookies to help us identify you when you visit our Web sites. We also use cookies to keep track of which sections of our Web sites you visited and for how long in order to determine how to best communicate to you.

HOW DOES MOTOLEASE USE THE INFORMATION?

We use Customer Information for our everyday business purposes such as process transactions, verify and approve applications, maintain your account, respond to court orders and legal investigations or to report to credit bureaus. Your information can also be shared with our dealer partners, advisors, service providers for such purposes.

Customer Information is also used to complete transactions you initiate on our Web sites such as processing credit card or banking information.

We also use Customer Information to promote products and services offered by Us, our dealer partners, authorized operators, and business alliance companies.

We can also use your Customer Information to send you notifications, and marketing information regarding MotoLease and/or its partners by email, text or mail.

We can also use Customer Information to safeguard MotoLease against legal liability, engaging in debt collection, preventing fraud and complying with the law or inquiries from government regulatory agencies.

MotoLease may also share Customer Information in the form of aggregated, anonymous demographic information with any third party.

MotoLease may also share Customer Information with our dealer partners, authorized operators and business alliance companies for joint marketing programs, that is, to offer you products and services.

HOW CAN I LIMIT THE USE OF MY CUSTOMER INFORMATION?

You can request at any time in writing to cease the sharing of your Customer Information with non-affiliates for joint marketing efforts at:

Making such a request will not eliminate your Customer Information from the lists and database of Motolease, its affiliates, dealer partners, business alliance partners and service providers. You should contact those third parties directly to find out about their use of your Customer Information.

HOW WILL MOTOLEASE SAFEGUARD MY CUSTOMER INFORMATION?

To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards and secured files and buildings. We authorize our employees to get your information only when they need it to do their work, and we require companies that work for us to protect your information.

HOW DOES MOTOLEASE MODIFY ITS PRIVACY POLICY?

Changes to the Privacy Policy will be posted here. If our privacy practices extend the scope of our current privacy practices, we will use reasonable efforts to notify you and obtain consent from you or give an opportunity to opt-out when required by law in advance of those changes.

US PATRIOT ACT PROCEDURES AND NOTICE

Section 326 of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (USA PATRIOT Act) and its implementing regulations (31 CFR 103.121) require us to:

• Verify the identity of any person applying for a lease, to the extent reasonable and practicable.

  2. We may rely on documents such as government-issued identification evidencing nationality or residence and bearing a photograph and/or signature such as a driver’s license, an identification card or a passport.
• Maintain records of the information used to verify the person's identity, including name, address, and other identifying information.
  1. We will preserve the information used for this procedure for at least five years from the date of lease termination.
• Determine whether the person appears on any lists of known or suspected terrorists or terrorist organizations provided to the financial institution by any government agency.
  1. MotoLease compares the name of each borrower to any list of known or suspected terrorists or terrorist organizations issued by any federal government agency and designated as such by the Treasury Department in consultation with the federal functional regulators. We do this within 30 business days after the lease application.

Electronic Transactions, Records and Signatures Consent and Policy (ESIGN)

Please read the following information carefully.

INTRODUCTION

In order for you to apply for and, if approved, receive a lease from MotoLease, LLC (“MotoLease”), you need to consent (1) to receive any lease agreement, all legally required disclosures, notices (including privacy notices), and other information (together, the "Electronic Records") in electronic form (either by e-mail or via the Internet) and (2) to use "Electronic Signatures" for entering into any lease agreement with MotoLease. Before you can consent as described above, MotoLease is required by law to provide you with certain information and disclosures about the use of the Electronic Records. This Statement on Use of Electronic Records ("Statement") is intended to provide you with such information and disclosures. You agree that all communications and disclosures that we provide to you electronically satisfy any legal requirements that the communications and disclosures be in writing. By clicking “I Agree” and submitting your application, you consent to receive Electronic Records.

YOUR RIGHT TO RECEIVE PAPER COPIES

You may receive paper copies of any of the Electronic Records by printing or downloading such Electronic Records directly to your computer, or by written request, with specific details of the Electronic Records you want, mailed to MotoLease, Attn: Electronic Records Request, 5200 W Century Blvd. Ste 750, Los Angeles CA 90045. Please enclose your name, the home address we have on record for you, and your mailing address, if different. Paper copies of the requested Electronic Records will then be provided at a reasonable fee to cover the cost of printing and mailing these Electronic Records.

WITHDRAWING CONSENT; UPDATING YOUR CONTACT INFORMATION

You may withdraw your consent to continue receiving Electronic Records at any time after your lease is executed, by contacting us at 844-466-8653. Please inform us when your contact information changes so we always have your latest email address and other contact information.

SCOPE OF YOUR CONSENT

Your consent applies to (1) all Electronic Records related to this lease request and transaction, if you receive a lease from MotoLease, and (2) all Electronic Records related to servicing your lease, including but not limited to privacy and collection notices.

HARDWARE AND SOFTWARE REQUIREMENTS

You understand that you will need to have access to certain hardware and software, such as Internet access, a relatively recent version of PDF software (e.g., Adobe Acrobat Reader), the ability to print, e-mail access, and a relatively recent version of a web browser (e.g., Internet Explorer, Safari, Firefox or Chrome) in order to access and retain the communications and disclosures electronically. By clicking “I Agree”, you acknowledge that you have the ability to access and retain PDF files. Subject to our documentation retention policies, you have the right to withdraw your consent and/or receive any of the legally required disclosures we have given to you in paper form, but we may charge you a reasonable fee to cover the cost of printing and mailing these Electronic Records.
